Should Judge Loya death case be probed? SC to hear review petition today

New Delhi: The Supreme Court will today hear the Bombay Lawyers Association’s plea seeking review and recall of its judgment that held that Special CBI Court Judge BH Loya had met natural death and that a PIL was misused for advancing political agenda.

The court has decided to give the matter a private hearing “in chamber”.

Judge Loya death caseA three judge Bench headed by Chief Justice Dipak Misra had on April 19 rejected a plea seeking SIT probe in Judge Loya’s death saying that he died of “natural causes” and the case doesn’t merit a further inquiry.

“It gives a sense of anguish that the proceedings were converted to scandalise the judiciary bordering on contempt,” the bench had said.

Judge Loya death caseJudge Loya died of a cardiac failure on December 1, 2014. He was conducting a trial in a case related to the alleged fake encounter killing of Sohrabuddin Sheikh in November 2005.

The Bombay Lawyers Association was one of the petitioners who pleaded for a Special Investigation Team probe into the death, which the Supreme Court declined.

Now, the review petition filed in the top court says the judgment “has resulted in miscarriage of justice, if not complete negation of justice on the facts of the case. It is therefore clearly required in the interests of justice that the judgment and order in question be reviewed and recalled”.

Judge Loya death caseLast year, the family of judge Loya alleged that there were suspicious circumstances about his death, it triggered a huge controversy and called for an independent investigation.

In January, judge Loya’s son Anuj Loya said the family no longer had any suspicion about the death.
